RAJLO Driver Agreement
This Driver Agreement (“Agreement”) is entered into between RAJLO (“RAJLO,” “Company,” “Platform,” “we,” “our,” or “us”) and the independent driver (“Driver,” “you,” or “your”) using the RAJLO platform within Jamaica.
By registering as a driver, accessing the RAJLO Driver App, accepting ride requests, or using the RAJLO platform in any manner, you agree to be legally bound by this Agreement.
1. Nature of the Platform
1.1 Technology Marketplace Platform
RAJLO is a technology platform that connects riders with independent third-party transportation providers.
RAJLO does not:
- Provide transportation services directly
- Employ drivers
- Operate vehicles
- Control driver schedules
- Supervise routes or driving decisions
- Guarantee ride requests or earnings
- Drivers independently provide transportation services to riders.
2. Independent Contractor Relationship
2.1 Independent Contractor Status
Drivers using the RAJLO platform are independent contractors and are not:
- Employees of RAJLO
- Agents of RAJLO
- Partners or joint venturers
- Representatives of RAJLO
Nothing in this Agreement creates:
- Employment rights
- Salary entitlement
- Pension rights
- Health benefits
- Vacation pay
- Overtime compensation
- Workers’ compensation coverage
2.2 Driver Control
Drivers maintain full control over:
- Work hours
- Availability
- Acceptance of ride requests
- Routes taken
- Vehicle operation
- Working locations within Jamaica
- Drivers may choose when and whether to use the RAJLO platform.
3. Driver Eligibility Requirements
Drivers must:
- Possess a valid Jamaican driver’s license
- Maintain all legally required permits and authorizations
- Comply with Jamaican Transport Authority regulations
- Maintain legally required insurance coverage
- Operate a roadworthy vehicle
- Maintain accurate account information
- Successfully complete any onboarding or verification requirements required by RAJLO
- RAJLO reserves the right to approve, reject, suspend, or deactivate driver accounts at its sole discretion.
4. Driver Responsibilities
Drivers are solely responsible for:
- Safe vehicle operation
- Passenger safety
- Vehicle maintenance and cleanliness
- Fuel and operating expenses
- Mobile devices and internet connectivity
- Taxes and statutory obligations
- Compliance with Jamaican laws and regulations
- Professional conduct toward riders
- Drivers agree to provide transportation services lawfully, safely, and professionally.
5. Vehicle Requirements
Drivers must ensure that vehicles used on the platform:
- Are legally registered
- Are roadworthy and safe
- Meet Jamaican legal requirements
- Maintain valid fitness and insurance documentation
- Are clean and reasonably maintained
- Meet any RAJLO platform standards communicated from time to time
- RAJLO may request updated documentation at any time.
6. RAJLO Services
RAJLO currently supports:
- RAJLO Private Ride — on-demand private transportation
- RAJLO Route — route-based transportation operating on Jamaican taxi routes and fare systems
- RAJLO reserves the right to modify, suspend, add, or remove services at any time.
7. Driver Earnings & Platform Fees
7.1 Driver Earnings
Drivers are eligible to earn fares generated from completed trips facilitated through the RAJLO platform.
7.2 Platform Commission
RAJLO may charge platform commissions, service fees, processing fees, or other deductions from driver earnings.
Applicable fee structures may be updated periodically at RAJLO’s discretion.
7.3 No Earnings Guarantee
RAJLO does not guarantee:
- Ride volume
- Passenger demand
- Minimum earnings
- Driver profitability
- Availability of trip requests
Driver earnings depend on numerous factors, including:
- Market demand
- Driver availability
- Competition
- Location
- Traffic conditions
- Rider behavior
- Drivers assume all financial risks associated with operating independently.
8. Cashless Payments
8.1 Electronic Payments
RAJLO operates as a cashless platform.
Drivers agree that:
- Rider payments are processed electronically
- Payout timing may vary
- Processing delays may occur
- Third-party payment processors may experience interruptions
8.2 Payment Disputes
RAJLO reserves the right to:
- Investigate disputed fares
- Reverse fraudulent transactions
- Withhold payouts where necessary
- Adjust driver balances for refunds, chargebacks, fraud investigations, or policy violations
9. Driver Conduct Standards
Drivers must:
- Treat riders respectfully
- Follow Jamaican traffic laws
- Avoid discrimination or harassment
- Refrain from threatening behavior
- Maintain professional conduct
- Avoid impaired driving
- Avoid illegal activities
Prohibited conduct includes:
- Fraudulent trips
- Fake GPS activity
- Fare manipulation
- Harassment
- Violence
- Drug or alcohol impairment
- Unauthorized account sharing
- Criminal activity
10. Trip Acceptance & Cancellation
Drivers are expected to minimize unnecessary cancellations after accepting ride requests.
Drivers may cancel trips for legitimate reasons, including:
- Safety concerns
- Rider misconduct
- Vehicle issues
- Emergencies
- Incorrect pickup information
- Technical failures
Excessive cancellations may result in:
- Reduced trip priority
- Temporary restrictions
- Suspension
- Permanent deactivation
- RAJLO reserves the right to evaluate cancellation patterns at its sole discretion.
11. Insurance & Liability
11.1 Driver Insurance Responsibility
Drivers are solely responsible for maintaining all legally required insurance coverage.
RAJLO does not provide:
- Vehicle insurance
- Health insurance
- Workers’ compensation
- Accident coverage
- Liability coverage for drivers
11.2 Assumption of Risk
Drivers acknowledge that transportation services involve inherent risks, including:
- Accidents
- Injuries
- Criminal acts
- Vehicle damage
- Passenger disputes
- Technical failures
- Financial losses
- Drivers voluntarily assume all risks associated with operating on the platform.
12. Limitation of Liability
To the fullest extent permitted under Jamaican law:
RAJLO, its owners, affiliates, officers, directors, employees, contractors, licensors, and partners shall not be liable for:
- Personal injury
- Death
- Vehicle damage
- Lost profits
- Lost income
- Business interruption
- Criminal acts
- Passenger misconduct
- Technical failures
- GPS inaccuracies
- Network outages
- Delayed payouts
- Third-party disputes
- Government enforcement actions
- Driver losses or expenses
- Drivers use the platform entirely at their own risk.
13. Indemnification
Drivers agree to defend, indemnify, and hold harmless RAJLO and its affiliates from any claims, liabilities, damages, losses, legal expenses, fines, or costs arising from:
- Driver misconduct
- Traffic violations
- Accidents
- Passenger claims
- Violations of Jamaican law
- Insurance failures
- Vehicle defects
- Unauthorized account activity
- Breach of this Agreement
14. Technology & Service Availability
RAJLO does not guarantee uninterrupted operation of:
- Mobile applications
- GPS systems
- Dispatch systems
- Payment systems
- Notifications
- Mobile networks
- Mapping services
- Temporary outages, delays, bugs, or technical failures may occur.
- The platform is provided “as is” and “as available” without warranties of any kind.
15. Account Suspension & Deactivation
RAJLO reserves the right to suspend, restrict, or permanently deactivate driver accounts at any time for:
- Policy violations
- Fraudulent activity
- Unsafe behavior
- Criminal activity
- Excessive cancellations
- Poor platform conduct
- Legal or regulatory concerns
- Failure to maintain required documentation
- RAJLO may take action without prior notice where necessary to protect platform integrity or user safety.
16. Confidentiality & Platform Protection
Drivers agree not to:
- Reverse engineer the platform
- Copy platform systems
- Share confidential company information
- Manipulate platform algorithms
- Use bots or unauthorized automation
- Abuse promotions or referral systems
- RAJLO reserves all rights relating to its intellectual property, branding, software, and systems.
17. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of Jamaica.
Any disputes arising from this Agreement or use of the platform shall be subject to the jurisdiction of the courts of Jamaica.
18. Agreement Updates
RAJLO reserves the right to modify or update this Agreement at any time without prior notice.
Continued use of the platform after updates constitutes acceptance of the revised Agreement.
19. Driver Acknowledgment
By using the RAJLO platform, drivers acknowledge and agree that they:
- Have read and understood this Agreement
- Operate as independent contractors
- Are solely responsible for their transportation services
- Assume all operational risks
- Agree to comply with Jamaican laws and platform policies
- Release RAJLO from liability to the fullest extent permitted under Jamaican law
This document forms part of your agreement with RAJLO. By continuing to use the RAJLO platform you accept this policy as currently published. RAJLO records the version of each policy you accept, with a timestamp, for both parties' protection.
